Reem Assil abandons her assault on the first amendment

Since the summer, there have been a series of vigils at Reem's California, an Oakland bakery that features a floor to ceiling mural of convicted terrorist Rasmea Odeh.

Rasmea Odeh, a member of the PFLP terrorist group was recently deported from America for not disclosing her role in a grocery store bombing that led to the deaths of Leon Kanner and Edward Joffe.

In true "progressive" fashion,  the initial response to these vigils was a physical attack on the participants.  There were multiple attempts to harass and intimidate the participants. Mall security and the Oakland police department were repeatedly called. When that failed to stop the vigils, libelous reports about the participants began appearing across the web.  


The "progressive" response from bakery owner Reem Assil, a self described "community organizer" was to file for a restraining order, which was ultimately denied by the court. Twice.

The lawsuit against Mr. Lumish has been dismissed by the plaintiff, Reem Assil. Early yesterday morning, we provided notice to Ms. Assil’s counsel that we were going to appear in court ex parte on Wednesday to adjust certain pending case dates because we would be filing later that day – on behalf of Mr. Lumish – a motion to strike Ms. Assil’s case as a Strategic Lawsuit Against Public Participation (“SLAPP” suit) designed to chill Mr. Lumish’s exercise of his free speech rights. A few hours later, while we were waiting for the Court to provide a hearing date for our Anti-SLAPP motion, we received word from the Court of the plaintiff’s voluntary dismissal.

Because Ms. Assil’s lawsuit against Mr. Lumish was precisely the type of effort to use the courts to try to obtain a content-based prior restraint on political speech, which California law does not countenance, we are very pleased that Mr. Lumish is no longer facing the burden of having to deal with such an action and attempt to intimidate him and others from engaging in peaceful protest. In light of the time and effort that we were required to invest in order to vindicate Mr. Lumish and to stand up for his free speech rights, we are considering the possibility of recovering defense fees and costs from Ms. Assil and/or her counsel in connection with this action and with their effort to silence protest against Ms. Assil’s own political speech and choice to use her restaurant to honor a convicted murderer and terrorist.

The take home lesson is that when we fight back, we win. This path is not easy, but this is the path. We can not let ourselves give in to threats and intimidation.

Mike Lumish has issued a statement, in a post chag spirit of t'shuvah.

Reem Assil and her malicious, anti-Zionist friends challenged the First Amendment to the Constitution of the United States and promptly got their legalistic butts kicked.

{Good for them.}

Anyone who followed the story of Assil's extremist and terrorist-admiring restaurant at the Fruitvale BART Station in Oakland knows that her attorneys dismissed her malicious "lawfare" action against Bob Pave, Robin Dubner, and myself.

This was due to the insightful work of Mitch Danzig, Evan Nadel, and Paul Huston of the law firm, Mintz Levin.

Speaking strictly for myself, I owe those gentlemen a significant debt of thanks.

There are, however, a few loose ends dangling that I want to tie up.

The first is that I owe an apology to StandWithUS, particularly Randy Kessler, Executive Director of the Northwest chapter.

And I owe a big tip 'o the kippa to Yael Lerman, Director of the SWU legal department.

{Were I her I do not know that I would have been quite so nice to me.}

When, during the vigils, it looked as if we would get zero support from the larger San Francisco Bay Area Jewish community, I lambasted that organization and stormed into Kessler's Facebook space with a self-righteous fit.

It was inappropriate, unfair, and I was wrong to do it.

Nonetheless, despite my bad manners, SWU did more to help the ongoing vigils at Reem's than any synagogue or other Bay Area Jewish organization.

Why is Jewish Voice for peace hosting an unrepentant Jew-killer at their annual conference?

Edward Joffe and Leon Kanner were friends and classmates at Hebrew University. On February 21, 1969 they were murdered by a terrorist bomb placed in a Jerusalem grocery store.

Rasmea Odeh was convicted of placing the bomb.

In spite of the overwhelming evidence of her involvement in the Jerusalem terror attack, Rasmea Odeh is free today and living in America. She has resurfaced because of allegations of immigration fraud- her role in the murders and her involvement with the PFLP terror group were fraudulently left out of her immigration request.

Greenstar food Coop says no to BDS

After repeated failures in Brooklyn, Sacramento, Davis and elsewhere, JVP has spared no expense in attempting revive the moribund movement to pressure food coops to boycott Israeli products.

The Greenstar Food Coop of Ithaca, New York has been their focus for the last few months, under fire for daring to sell Sabra hummus, Tribe hummus, and Israeli peppers.

After being called out and exposed for their vitriolic rhetoric and shockingly insensitive imagery the boycott promoters (then using the name Central NY Committee for Justice in Palestine – CNYCJP) rebranded themselves as the Ithaca Committee for Justice in Palestine, and finally as Ithaca Food Justice for Palestine Campaign. 

Fortunately for the forces of truth and justice, the good folks at Legal Insurrection have been all over this.

The Ithaca Coalition for Unity and Cooperation in the Middle East, a bi-partisan, multi-denominational group formed to fight the boycott attempt submitted extensive papers to the GreenStar Council challenging the referendum as contrary to GreenStar’s Bylaws in that the referendum, among other things, (1) did not comply with GreenStar’s referendum Petition requirements because the wording was changed after the petitions were signed and was false and misleading; (2) violated the NY State Human Rights Law which prohibits boycotts based on national original; (3) was economically irresponsible in that it would damage GreenStar’s brand and cause economic loss in light of widespread community opposition; and (4) violated GreenStar’s own anti-discrimination policies.

The divestment initiative was rejected  unanimously by the GreenStar Council based on the NY State Human Rights law prohibition of boycotts based on national origin.

Congress oppossed to academic boycott of Israel

134 House Members sign letter against academic boycott of Israel

 A total of 134 Members of the House of Representatives have signed a letter, organized by the offices of Reps. Peter Roskam (R) and Ted Deutch (D) condemning the academic boycott of Israel passed by the American Studies Association. The effort was truly bipartisan, with 65 Republicans and 69 Democrats signing. The full list of signatories is at the bottom of this post.

Via Legal Insurrection: As pressure mounts, academic boycotters play victim.

William Jacobson at Legal Insurrection has been taking the lead at exposing the agenda of the American Studies Association boycott of Israeli academic institutions, and has served as an inspiration in orchestrating a response.

Anti-Israel academic boycotters complain criticism violates their academic freedom to boycott

The anti-Israel academic boycott launched by the American Studies Association and two smaller groups has been denounced by several dozen universities and colleges, among others, as a grievous attack on the academic freedom of everyone. The rebukes have been stunning in their severity.
Here are just three examples from dozens of University statements rejecting the academic boycott of Israel :
  • Former Indiana Gov. Mitch Daniels, now President of Purdue University: ”This is as clear a violation of academic freedom as one can imagine.  We (Purdue) do not appear to have any institutional relationship with the American Studies Association, but are checking to see whether any of our departments do.”
  • Ron Liebowitz, President of Middlebury College: “the vote is a sad reflection of an extreme and hateful ideology of some members of the academy ….  I urge others in the academic community to condemn the ASA boycott and reaffirm their support for academic freedom.”
  • James F. Jones, Jr., President of Trinity College (CT) writing to the President of ASA: “Trinity once years back was an institutional member… Were we still an institutional member, we would not be any longer after the misguided and unprincipled announcement of the boycott of the only democracy in the Middle East…. As President of the ASA, you have tarnished a once distinguished association”
The accumulation of similar statements from University Presidents and others — including people who are critical of Israeli policies — surely must sting the academic boycotters, who are under the misconception that the American world is run by the “Israel Lobby.”
To the contrary, there is near universal condemnation from a wide range of American civil society — that condemnation is heartfelt, willingly given, and reflects the best traditions of American academic life.
 The refusal of American civil society to acquiesce in the anti-Israel boycotters’ attack on academic freedom is not itself an attack on academic freedom.
 In full on panic mode as their delegitimization strategy  crumbles to pieces, the U.S. Campaign for the Academic and Cultural Boycott of Israel (USACBI) is scrabbling to provide a response. Their current campaign focuses on their inevitable fallback position,  "Wait! We're the victims! Really, we are", with an occasional nod to their slightly more introspective rationalization, "the ASA resolution has had tremendous effect on starting debate on Palestine.", segueing into the inevitable "When we lose, we still win".


To the American Studies Association, academic freedom gives them the right to deprive others of academic freedom

The academic boycott of Israel is the hill to fight on

We will continue to rally support among American civil society.  That support comes willingly, as one of the movers behind the Boycott, Divest and Sanction (BDS) movement in the U.S., who runs the Electronic Intifada website, lamented today on Twitter:
The BDS movement went too far this time.  Its position on academic boycotts is indefensible.
The supporters of academic BDS have exposed themselves as the threat to civil society they are. It’s easy to laugh when they do flash mobs outside coffee shops and in grocery stores and call for the boycott of hummus.  It’s not so easy to laugh when they shout down speakers.
It creates spontaneous outrage when they use academic organizations as political tools and easily cast aside the academic freedom of everyone in their desire to damage Israel.
BDS charged up the wrong hill.
When some of the harshest critics of Israeli policies say an academic boycott of Israel is too much, the academic BDS movement has no ground to stand on.
This is not, as Electronic Intifada claims, a counterattack by the Israel Lobby. It’s a counterattack by American civil society, and soon political society, against the attack on our core freedoms.
Don’t let this pass with just denunciations.
This is the hill to fight BDS on.

StandWithUs has also come out with practical steps you can take to fight back.


1.    WRITE TO THE PRESIDENT OF UNIVERSITIES/COLLEGES WITH WHICH YOU ARE AFFILIATED AS A STUDENT, PARENT OF STUDENTS, ALUM, FACULTY, OR DONOR.  URGE THE PRESIDENT TO:
  •  Withdraw the school from the ASA if it is an institutional member of the organization.
  •  Publicly denounce the ASA and the academic boycott. In 2007, over 300 presidents of American universities signed a statement deploring academic boycotts as "utterly antithetical to the fundamental values of the academy," and declared, "Boycott Israeli universities? Boycott ours too!" University leaders should have the same united response today.
  •  Not allow university funds to be used for ASA-related activities.  The ASA has demonstrated that it is a politicized organization, no longer one of scholars devoted to research and education.  As former Harvard University president Lawrence Summers, said "My hope would be that responsible university leaders will become very reluctant to see their university funds used to finance faculty membership and faculty travel to an association that is showing itself not to be a scholarly association but really more of a political tool."
  • Publicly deplore the ASA`s travesty of scholarship, research and analysis, and reassure the community that the school will uphold scholarly standards.  The resolution is based on distortions, erasure of context, and false or disputed claims, and uses circular reasoning or irrational leaps of logic. It is not based on sober, reasonable analysis or rational analysis of evidence. It is an assault on the most elementary scholarly standards.
  •  Publicly denounce the ASA`s assault on Israel.  BDS is an extremist movement that defames the Jewish state and denies the Jewish people`s rights to self-determination, statehood, and security.  This resolution is destructive: it does nothing to further peaceful coexistence and a resolution of the conflict. Furthermore, as former Harvard University president Lawrence Summers noted, singling out Israel for opprobrium is anti-Semitic in effect if not in intent.
  • Actively seek more institutional partnerships with Israeli universities: an anti-academic boycott of Israel. Israel`s extraordinary achievements in scholarship and research in multiple fields have benefited the world.  American schools should dramatically increase their partnerships with Israeli academia to further such contributions.
2.    WRITE TO YOUR CONGRESSIONAL AND STATE REPRESENTATIVES, AND URGE THEM TO:
  • Publicly denounce the ASA resolution.  This bigoted resolution is an assault on academic freedom, educational standards, and Israel. Public officials should join together to denounce it.
  •  Urge schools that are ASA institutional members to sever their association. (The list of 83 schools that are institutional members is below.)  
  •  Ensure that public funds are not used to support ASA activities.   Many schools receive federal and/or state funding.  Government officials should not permit public funds designated for education to be used for political activities, and certainly not for political extremism and bigotry.
  •  Encourage and facilitate partnerships between Israeli academia and American schools.
